These Terms of Service (“Terms”) govern your use of the iSnow website, online store, booking system and related products and services.

The iSnow website and services are operated by Snow Store Ltd. (שלג סטור בע״מ), Company No. 516567617 (“iSnow”, “we”, “us” or “our”).

By accessing the Website, submitting a request, selecting a booking date, placing an order or purchasing an iSnow snow experience, you agree to these Terms and to the policies referenced in them.

These Terms are subject to applicable Israeli law, including the Consumer Protection Law, 5741–1981 and applicable regulations.

Nothing in these Terms limits or excludes any consumer right or remedy that cannot legally be waived under Israeli law.

1. About iSnow

iSnow provides real snow experiences for events in Israel, including birthdays, kindergartens, schools, private celebrations, villas, corporate events, productions and other suitable occasions.

Our snow is produced from water and air and is prepared for use as real snow at the customer’s event.

Depending on the product purchased, an iSnow order may include:

  • a specified snow experience or quantity of real snow;
  • reservation of a specific date and time;
  • preparation of snow for the booked event;
  • delivery or transportation to the agreed location, where applicable;
  • related equipment, containers or accessories where expressly included; and
  • other services expressly described on the relevant product page or order confirmation.

2. Eligibility and Use of the Website

Orders and bookings through the Website are intended to be made by adults who have legal capacity to enter into a transaction.

If an iSnow experience is purchased for children, the purchase and booking should be made by a parent, guardian, educational institution or other authorized adult.

You agree to provide information that is accurate, current and complete when placing an order or communicating with us.

You may not use the Website for unlawful, fraudulent or malicious purposes or in a way that interferes with its operation or the rights of others.

3. Product and Service Information

We make reasonable efforts to describe our snow experiences accurately.

Each product page may include information such as:

  • the name of the snow experience;
  • the approximate quantity of snow included;
  • the price;
  • suggested event types or uses;
  • available booking dates and times; and
  • other relevant details.

Photographs and videos on the Website are illustrative. The exact appearance, texture and condition of real snow may naturally vary depending on temperature, weather, sunlight, handling and the environment at the event.

Such natural variations do not by themselves mean that the product or service is defective.

4. Real Snow and Natural Melting

Real snow is temperature-sensitive and naturally melts over time.

Its condition may be affected by factors including:

  • air temperature;
  • direct sunlight;
  • ground temperature;
  • wind;
  • rain or humidity;
  • the location of the event;
  • the surface on which the snow is placed; and
  • the amount and manner of use.

The customer understands that melting is an inherent and expected characteristic of real snow, particularly during the Israeli summer.

5. Booking Dates and Times

Certain iSnow products require the customer to choose an available date and time before completing the order.

Availability displayed in the booking calendar is subject to existing bookings, operating capacity and technical availability.

A date or time is not guaranteed solely because it appears available while browsing the Website.

A booking is confirmed only after the applicable checkout process has been completed and iSnow has issued an order or booking confirmation.

The Website may temporarily reserve availability while a customer is completing checkout.

6. Orders and Acceptance

Submitting an order constitutes a request to purchase the selected iSnow experience.

We may verify the order, payment, booking information and availability before confirming it.

We may refuse or cancel an order where reasonably necessary, including in cases of:

  • a payment failure or suspected fraud;
  • an obvious pricing or technical error;
  • duplicate or conflicting bookings caused by a technical malfunction;
  • incorrect information supplied by the customer;
  • an event location that cannot reasonably be serviced;
  • a safety concern;
  • lack of availability; or
  • another circumstance that makes performance impossible or unlawful.

If we cancel an order that has already been paid and the customer is entitled to reimbursement, we will provide the applicable refund in accordance with Israeli law and our Return & Refund Policy.

7. Prices

Consumer prices displayed on the Website are stated in Israeli New Shekels (₪).

Prices displayed to consumers will include applicable taxes and other mandatory charges that must be included in the total price under Israeli law.

If an additional delivery, transportation or other optional charge applies to a particular order, it will be disclosed to the customer before the order is completed.

The final amount payable will be displayed during checkout before payment is submitted.

Prices and available products may change from time to time. Such changes do not affect a previously confirmed order unless otherwise required or permitted by law.

8. Payment

Payment is processed through Shopify and the payment methods made available through our checkout, which may include third-party providers such as PayPal.

By submitting payment information, you confirm that you are authorized to use the selected payment method.

Payment processing may also be subject to the terms and privacy practices of the applicable payment provider.

iSnow does not intentionally store complete payment-card numbers or CVV information on its own systems.

9. Delivery and Event Location

Where delivery or transportation is part of the order, the customer must provide complete and accurate information regarding the event location.

The customer should notify iSnow in advance of relevant access conditions, including where applicable:

  • difficult vehicle access;
  • stairs or lack of elevator access;
  • restricted entrances;
  • security procedures;
  • parking restrictions;
  • unusual carrying distances;
  • event-site restrictions; or
  • other circumstances that may materially affect delivery.

Delivery timing may depend on the location, traffic, weather and other circumstances.

We will make reasonable efforts to provide the confirmed service at the agreed time.

Nothing in this section limits a customer’s rights where iSnow fails to provide the product or service at the agreed time in circumstances for which Israeli law provides a remedy.

10. Customer Responsibilities at the Event

The customer is responsible for providing a location that is reasonably suitable for the booked snow experience.

The customer should follow any reasonable preparation, access or safety instructions provided by iSnow before or during the event.

Where children participate, appropriate adult supervision must be provided by the parent, guardian, educational institution, event organizer or other responsible adult.

Snow and melted water may make certain surfaces wet or slippery. Customers and event organizers should take reasonable precautions appropriate to the location and participants.

These responsibilities do not remove or reduce any duty imposed on iSnow by applicable law.

11. Changes to a Booking

If you wish to change the date, time, event location or other material detail of a confirmed booking, please contact us as early as possible.

Requested changes are subject to availability and are not confirmed until accepted by iSnow.

A material change may result in a price adjustment where the new request involves a different product, location or service.

If a requested change cannot be accommodated, the cancellation provisions of our Return & Refund Policy and applicable Israeli law will apply.

12. Cancellation and Refunds

Online purchases and bookings are subject to the cancellation rights provided by Israeli law and to our Return & Refund Policy.

Where a statutory cancellation right applies, applicable time limits, exclusions and cancellation fees will be determined in accordance with the Israeli Consumer Protection Law and applicable regulations.

Where permitted by law, a cancellation fee may be up to 5% of the transaction value or ₪100, whichever is lower.

A cancellation fee will not be charged where the law prohibits such a fee, including applicable cases involving a defect, non-conformity or failure to provide the product or service at the agreed time.

Fresh snow is a perishable product and, once produced and/or delivered, cannot be returned or restocked like an ordinary durable retail product.

This does not limit statutory cancellation, refund or other consumer rights that apply to the particular transaction.

13. How to Submit a Cancellation Request

Where a customer has a right to cancel a transaction, cancellation may be submitted by the methods required under applicable Israeli law.

  • registered mail to our business address; and
  • any other cancellation method required by applicable law.

A cancellation request should include sufficient information to identify the customer and transaction, including the customer’s name and the identifying information required by law.

14. Weather and Circumstances Outside Our Control

Outdoor events may be affected by weather and other circumstances that cannot reasonably be controlled.

If severe weather, emergency conditions, government restrictions, security circumstances, road closures or another event beyond reasonable control materially affects a confirmed booking, the parties should contact each other as soon as possible.

Where reasonably possible, iSnow may offer an alternative time or date.

Any right to cancel, receive a refund or obtain another remedy will be determined according to the circumstances, these Terms and applicable law.

15. Website Errors and Availability

Although we take reasonable steps to maintain accurate information, occasional technical, typographical, pricing or availability errors may occur.

We may correct an obvious error and, where necessary, contact the customer before fulfilling the order.

If an order cannot lawfully or reasonably be fulfilled because of such an error, the customer will be informed and any applicable payment will be handled in accordance with applicable law.

16. Shopify and Third-Party Services

The iSnow online store is powered by Shopify.

Shopify provides ecommerce infrastructure including storefront, cart, checkout and related functionality.

Purchases made from the iSnow store are transactions between the customer and Snow Store Ltd., not between the customer and Shopify.

We may also use third-party tools in connection with our services, including BookThatApp (BTA) for booking dates, availability and reservation management, and third-party payment providers.

Third-party services may also be governed by their own applicable terms and privacy policies.

17. Privacy

Our collection and use of personal information is described in our Privacy Policy.

By using the Website, you acknowledge that certain information may be processed by service providers used to operate the Website, booking functionality, checkout and payment services.

18. Intellectual Property

Unless otherwise indicated, the Website and its content, including the iSnow name, branding, logos, text, graphics, photographs, videos, designs and other original materials, are owned by or licensed to iSnow and are protected by applicable intellectual property laws.

You may use the Website for ordinary personal and lawful purposes.

You may not reproduce, distribute, commercially exploit, modify or republish protected Website content without authorization, except where permitted by applicable law.

Third-party trademarks and materials remain the property of their respective owners.

19. Reviews, Feedback and Customer Content

If you voluntarily provide a review, testimonial, suggestion or other feedback, you confirm that you have the right to provide it and that it does not unlawfully infringe the rights of another person.

We may use genuine customer reviews and feedback for reasonable business purposes, subject to applicable privacy, advertising and intellectual property laws.

Identifiable photographs or videos of customers or children will be used for promotional purposes only where an appropriate legal basis or permission exists.

20. Prohibited Uses

You must not use the Website:

  • for an unlawful or fraudulent purpose;
  • to impersonate another person;
  • to submit knowingly false information;
  • to interfere with the security or operation of the Website;
  • to introduce viruses, malware or harmful code;
  • to obtain unauthorized access to systems or accounts;
  • to unlawfully collect personal information about others;
  • to infringe intellectual property or privacy rights; or
  • to use automated tools in a way that materially disrupts the Website.

21. Limitation of Liability

Nothing in these Terms excludes or limits liability or consumer rights where such exclusion or limitation is prohibited by Israeli law.

Subject to the above, iSnow will not be responsible for losses caused solely by circumstances beyond our reasonable control or by the customer’s failure to follow reasonable instructions relating to the event or service, except to the extent responsibility is imposed on iSnow by applicable law.

Information on the Website is intended to describe and support our products and services and should not be interpreted as excluding any representation, warranty or statutory obligation that cannot legally be excluded.

22. Third-Party Links

The Website may contain links to independent third-party websites or services.

We are not responsible for the content or privacy practices of independent third-party websites that we do not control.

Customers should review the applicable terms and policies of a third party before using its services.

23. Suspension or Termination of Website Access

We may restrict or suspend access to the Website where reasonably necessary, including to protect the Website, customers, systems or third parties from fraud, abuse, security threats or unlawful activity.

Termination or suspension of Website access does not affect rights and obligations arising from an existing confirmed order, except as permitted by applicable law.

24. Severability

If a provision of these Terms is found to be invalid or unenforceable, that provision will apply to the maximum extent permitted by law and the remaining provisions will continue in effect.

25. Governing Law

These Terms and transactions made through the iSnow Website are governed by the laws of the State of Israel.

Any dispute will be handled by the competent courts in Israel in accordance with the applicable rules of jurisdiction.

Nothing in this section deprives a consumer of a mandatory right to bring a claim before a court that has jurisdiction under applicable Israeli law.

26. Changes to These Terms

We may update these Terms from time to time to reflect changes in our services, Website, technology or applicable law.

The latest version will be published on the Website together with the applicable “Last updated” date.

Changes will not retroactively remove consumer rights that already arose under a confirmed transaction.
